1. Eligibility
   1. Participation in the My Energy Pilot is voluntary and subject to eligibility requirements established by NB Power.
   2. To be eligible, participants must:
      1. Be an NB Power residential customer.
      2. Receive electricity service directly from NB Power.
      3. Be the account holder or an authorized contact on the account.
      4. Have an operational AMI smart meter installed at the participating premise for at least one year prior to enrollment.
      5. Provide a valid email address.
      6. Have an active NB Power online account.
      7. Complete the registration process and agree to these Terms and Conditions.
   3. Customers who do not receive electricity service directly from NB Power are not eligible to participate.
   4. Commercial and industrial customers are not eligible to participate.
2. Enrollment and Participation
   1. Enrollment in the Pilot is limited and subject to Pilot capacity.
   2. Enrollment is limited to approximately 1,000 participants. Applications will be accepted on a first-come, first-served basis, subject to Pilot eligibility requirements.  Submission of a registration form does not guarantee acceptance into the Pilot until eligibility has been confirmed by NB Power. NB Power reserves the right to close enrollment once Pilot capacity has been reached. 
   3. Participants must accept these My Energy Pilot Terms and Conditions in order to participate in the Pilot. 
   4. Participants must complete enrollment prior to the Pilot launch date. 
   5. The Pilot is expected to operate between December 1, 2026 and March 31, 2027. 
   6. Participants will receive notifications of demand response events during the Pilot period. 
   7. Demand response events may occur during periods of high electricity demand and may vary in frequency, duration, and timing. 
   8. Participation in individual demand response events is voluntary. However, participants are encouraged to voluntarily reduce electricity consumption during demand response events by taking actions such as: 
      1. Adjusting thermostat settings 
      2. Delaying the use of major appliances 
      3. Reducing non-essential electricity consumption 
      4. Following other recommendations provided by NB Power. 
3. Verification and Measurement
   1. NB Power reserves the right to verify participant eligibility, enrollment information, and participation at any time during the Pilot.
   2. Electricity consumption data from the participant's AMI smart meter may be used to evaluate Pilot participation and performance. 
   3. NB Power may use baseline consumption data, event-period consumption data, and other measurement and evaluation methodologies to assess participant response during demand response events. 
   4. Participants agree to provide reasonable cooperation in support of Pilot administration and evaluation activities
4. Incentive Eligibility and Payment
   1. Eligible participants who meet the Pilot requirements may receive a $100 Incentive payment after the Pilot has concluded. Payment will be issued by Interac eTransfer using the email address provided during registration.
   2. To qualify for the $100 incentive payment, participants must meet the following Pilot requirements:
      1. Complete enrollment prior to the Pilot launch date.
      2. Remain enrolled in the Pilot throughout the Pilot period.
      3. Participate in at least 80% of demand response events called during the Pilot period, as determined by NB Power. NB Power reserves the right to adjust the minimum participation rate depending on the number and duration of demand response events called during the Pilot period.
   3. NB Power reserves the right to determine incentive eligibility based on Pilot participation records and measurement and evaluation results. Participation will be determined using Pilot measurement and evaluation methodologies established by NB Power.
   4. Any incentive payment earned by a participant will be issued by Interac e-Transfer using the email address provided during registration, following completion of the Pilot and verification of participation requirements.
   5. Participants who withdraw from the Pilot prior to completion will not be eligible to receive the incentive payment.
   6. Pilot incentives may be considered taxable. Participants are responsible for determining and meeting any applicable tax obligations.
5. Pilot Evaluation
   1. Participants may be invited to complete surveys, provide feedback, participate in interviews, or engage in other Pilot evaluation activities. 
   2. Participation in such evaluation activities is voluntary but strongly encouraged. 
   3. Information collected through Pilot evaluation activities may be used to improve future demand response programs, customer offerings, and energy management initiatives.   
   4. Pilot findings may be used to support the development of future demand response programs, customer offerings, and energy management initiatives. 
6. Communications and Consent
   1. Participants agree to receive communications related to the administration and operation of the Pilot.
   2. Communications may include: 
      1. Enrollment confirmations 
      2. Pilot updates 
      3. Demand response event notifications 
      4. Surveys and feedback requests 
      5. Incentive payment and eligibility information
      6. Other Pilot-related communications.
   3. Communications may be delivered through email, SMS, telephone, or other approved communication channels. 
   4. Participants are responsible for maintaining accurate contact information throughout the Pilot. 
7. Privacy, Data Collection, and Use 
   1. Personal information collected through the Pilot will be used only for Pilot administration, operation, evaluation, and improvement.
   2. Participants authorize NB Power to collect, use, and analyze the following personal information:
      1. Customer account information
      2. Contact information 
      3. Electricity consumption data
      4. Communication engagement information 
      5. Survey responses and participant feedback.
   3. Information collected through the Pilot will be handled in strict accordance with NB Power data collection and privacy policies and applicable privacy legislation, including the New Brunswick Right to Information and Protection of Privacy Act.
8. Pilot Changes and Termination
   1. NB Power reserves the right to modify, suspend, or terminate the Pilot at any time. 
   2. NB Power reserves the right to modify Pilot requirements, eligibility criteria, participation requirements, incentive amounts or thresholds, or these Terms and Conditions as required.
   3. In the event of Pilot cancellation, NB Power will determine how enrolled participants will be treated based on the circumstances at the time of cancellation. 
9. Warranties and Limitation of Liability 
   1. Participation in the Pilot does not guarantee electricity bill savings.  
   2. NB Power does not guarantee any specific reduction in electricity consumption or demand. 
   3. Participants are solely responsible for determining which energy-saving actions are appropriate for their household. 
   4. NB Power will not be liable for any loss, damage, inconvenience, cost, or expense arising from participation in the Pilot. 
   5. NB Power's sole obligation under the Pilot is the administration of the Pilot and payment of any approved incentive in accordance with these Terms and Conditions. 
10. Withdrawal 
    1. Participants may withdraw from the Pilot at any time by notifying NB Power. 
    2. Participants who withdraw will no longer be eligible for the Pilot incentive. 
11. Governing Law 
    1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of New Brunswick and the laws of Canada applicable therein.
